Welcome to the GotoTyumen website (gototyumen.com), a web resource designed to help you learn more about Tyumen and to provide all the tools necessary for you to plan your trip to Tyumen from any place in the world.
1. General Provisions
1.1. The present GotoTyumen Terms of Service (hereinafter – the Terms) refers to the Site of the Internet resource “GotoTyumen”, located at gototyumen.com and when addressed by the domain name gototyumen.com (including all levels of the specified domain functioning on the moment of adoption of these Terms by the User as well as added after that).
1.2. The Site of the Internet resource “GotoTyumen” (hereinafter – the Site) is the property of LLC “West-Siberian Reservation Center”.
1.3. The Terms regulate the relations between the Site Administration of the Internet resource “GotoTyumen” (hereinafter – the Site Administration) and the User of the Site.
1.4. The Administration reserves the right at any time to change, modify, add, or remove provisions of the Terms without a notice to the User.
1.5. Your continued use of this Site constitutes acceptance of the Terms and the changes made to the Terms.
1.6. The user is personally responsible for checking the Terms for any changes in it.
2. Definitions of Terms
2.1. The following terms are defined for purposes of the Terms the following meanings:
2.1.1 “GotoTyumen” – the Internet resource located at the domain name gototyumen.com operating through the Internet resource and related services.
2.1.2. The Internet resource is a Site that contains information about the services provided by the company “West-Siberian Center Reservation” in the field of tourism in Tyumen and other towns, cities of Tyumen region.
2.1.3. The Site Administration of the Internet resource is the authorized personnel of the Site management, acting on behalf of the organization name.
2.1.4. The User of the Site of the Internet resource (hereinafter - the User) – a person with access to the Site via the Internet and using the Site.
2.1.5. The Content of the Site of the Internet resource (hereinafter - the Content) is the protected results of intellectual activity, including the text, description of objects, names, articles, illustrations, artwork, audio and videos graphics, pictures, interfaces, visual interfaces, trademarks, logos, computer programs, databases, as well as the design, structure, selection, coordination, appearance, general style and arrangement of such Content, included in the Site and other intellectual property all together and separately contained on the Site of the Internet resource.
3. The Subject of the Terms
3.1. The subject of the Terms enables a user of the Internet resource access to the information, contained on the Site and rendered products and the services.
3.1.1. The Internet resource provides the User with the following services (the Services):
• visa support (applying for travel vouchers);
• booking and payment of flight and railway tickets;
• shuttle services, transportation services;
• booking and payment for accommodations in hotels and hostels of the city of Tyumen;
• reservation and purchase of the tickets for events;
• booking and payment for rental houses and cottages for the weekend;
• booking and payment for excursions;
• providing tourists and residents of Tyumen a general information about the city and its attractions, infrastructure, events, recreational areas, and restaurants;
• access to search tools and navigation of the Internet resource;
• giving the User the possibility of booking, sending applications, and contacting a staff member of the online resource;
• access to information about services and about purchasing paid services;
• other services designated on the pages of the Internet resource.
3.1.2. All currently existing (functioning) services of this Internet resource as well as any subsequent modifications or additional services appearing in the future of this Internet resource are subject to and comply with these Terms.
3.2. Access to this Internet resource is free of charge—without registration and/or creating a personal account.
3.3. The Terms are a public offer. By accessing the Site, the User accepts these Terms.
3.4. The use of materials and services of the Site is governed by the applicable laws of the Russian Federation. 4.1. The Site Administration has the right:
4.1.1. To change the Terms of Service of the Site and to change the content of this Site. The changes will come into force from the moment the revised Terms are placed on the Site.
4.1.2. To restrict access to the Site if you breach any of the articles of the Terms.
4.1.3. To change the amount of payment charged for the access to and use of the Site of the Internet resource. The changes will not be applied to the Users who have purchased the service and/or goods before the value changes on the Site of the Internet resource.
4.2. The user may:
4.2.1. Access the Site after complying with the terms of booking, payment, and the processing of personal data.
4.2.2. Use all available online services and purchase any goods offered on the Site.
4.2.3. Ask any questions relating the services of the Internet resource for details that are in the section “Payment and delivery”.
4.2.4. To use the Site solely for the purposes and in the manner provided by the Terms and not prohibited by the legislation of the Russian Federation.
4.3. The Site User undertakes the responsibility:
4.3.1. To provide the Site Administration with additional information that is relevant to the services provided by this Site.
4.3.2. To respect the property and moral rights of authors and other copyright holders when using the Site.
4.3.3. Not to take any action that may be regarded as violation of the normal functioning of the Site.
4.3.4. Not to distribute any confidential information about natural or legal persons on the Site—such information is protected by the legislation of the Russian Federation.
4.3.5. To avoid any action that may be regarded as a violation of private information protected by the legislation of the Russian Federation.
4.3.6. Not to use the Site for the distribution of advertisements, except when it is agreed upon with the Site Administration.
4.3.7. Not to use the Site services of the Internet resource with the aim of:
4.3.7.1. Uploading content that is unlawful and violates any third party rights; promoting violence, cruelty, hatred and / or discrimination on racial, ethnic, gender, religious, social grounds; containing inaccurate information and/or insults specific individuals, organizations and governments.
4.3.7.2. Motivation to commit unlawful acts and to assist individuals whose actions are aimed at violation of the restrictions and prohibitions in force in the territory of the Russian Federation.
4.3.7.3. Violations of the rights of minors and/or causing harm in any form.
4.3.7.4. Infringement of the minorities’ rights.
4.3.7.5. Representing oneself as another person or representative of an organization and/or a community without sufficient rights, including the personnel of the Internet resource.
4.3.7.6. Misrepresentation concerning the properties and characteristics of any goods from the catalogue of the Internet resource, placed on the Site.
4.3.7.7. Incorrect comparison of goods and formation of a negative attitude towards individuals (not) using certain products or conviction of such persons.
4.4. The user is prohibited:
4.4.1. To use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual process to access, acquire, copy, or monitor the Site content of this web resource;
4.4.2. To disturb the proper functioning of the Site;
4.4.3. To circumvent the navigational structure of the Site in order to obtain or attempt to obtain any information, documents or materials by any means not submitted by the services in the Site;
4.4.4. To access the functions of the Site, any other systems or networks connected to this Site, and to any services offered on the Site with any unauthorized means;
4.4.5. To violate the security or authentication on the Site or any network related to the Site.
4.4.6. To perform a reverse search or to trace or seek to trace any information on any other User of the Site.
4.4.7. To use the Site and its Content for any purposes prohibited by the legislation of the Russian Federation, inciting of any illegal activity or other activity infringing an Internet resource or others. 5.1. The Site and the content included in the Site are owned and operated by the Site Administration.
5.2. The content of the Site may not be copied, published, reproduced, transmitted or distributed in any way, or distributed on the Internet or any other network without the prior written consent of the Site Administration.
5.3. The Site content is protected by copyright, trademark law, and other rights related to intellectual property and unfair competition laws.
5.4. The Terms extend their validity to all additional terms and conditions for the purchase of goods and services offered on the Site.
5.5. The information provided on the Site should not be construed as a modification of these Terms.
5.6. The Site Administration has the right at any time and without notice to you to amend the list of goods and services offered on the Site as well as the rates applicable to such goods.
5.7. The documents specified in clauses 5.7.1 - 5.7.3 of the Terms govern the relevant parts of the Site and extend to the User's interaction with this Site. The Terms include the following documents:
5.7.1. Privacy Policy;
5.7.2. Payment and Shipping;
5.7.3. Limitation of Liability.
5.8. Any of the documents listed in paragraph 5.7. of these Terms may be updated. The changes will come into force upon their publication on the Site. 6.1. Any loss that the User may incur in the case of intentional or reckless violation of any provision of these Terms, as well as through any unauthorized access to or communication with another User, will not be reimbursed by the Site Administration.
6.2. The Site Administration is not responsible for:
6.2.1. Delays or failures in the process of transaction arising due to a force majeure, or any malfunction in telecommunications, computer, electrical and other related systems.
6.2.2. The actions of transfer systems, banks, payment systems, and the delays associated with their work.
6.2.3. The proper functioning of the Site, if the User does not have the necessary technical means for its use and shall have no obligation to provide such means. 7.1. The Site Administration has the right to disclose any information collected about the users of this Site if a disclosure is necessary in connection with the investigation or complaint regarding misuse of the Site or for the establishment (identification) of the User which can violate or interfere with rights Administration of the Site and/or the rights of other Users of the Site.
7.2. The Site Administration has the right to disclose any User information as it may deem necessary to implement the provisions of the current legislation or judicial decisions, to ensure compliance with the terms of this Terms, to protect the rights or safety of the name of the organization Users.
7.3. The Site Administration has the right to disclose User information if the legislation of the Russian Federation requires or permits such disclosure.
7.4. The Site Administration has the right, without a prior notice, to discontinue or block access to the Site if a User has breached these Terms or any other documents of the Terms of Service, in case of termination of the Site or some other technical problems.
7.5. The Site Administration shall not be liable to User or any third party for termination of your access to the Site if the User violates any provisions of the Terms or any other document that contains the Terms of Service. 8.1. In case of any differences or disputes between the Parties of these Terms it is mandatory to appeal to the court with the claim (a written proposal on the voluntary settlement of the dispute).
8.2. The recipient claims will be processed within 30 calendar days from the date of its receipt, along with a notification to the complainant about the outcome of a claim.
8.3. If you cannot resolve the dispute voluntarily, either party may apply to the court for protection of their rights available to them under applicable legislation of the Russian Federation.
8.4. Any claim in respect of the Terms of Service must be brought within a period of time after the occurrence of the grounds for the claim, except for the copyright protected in accordance with the law, the content of the Site. In the case of the violation of the Terms of this paragraph, any claim or cause of action are to be observed within the statute of limitations. 9.1. The Site Administration does not accept suggestions from the User regarding changes to this User Terms.
